In 2009 the SIS Act and income tax laws were changed to include same-sex relationships in the definition of dependent for the purposes of payment of death benefits. This means that the widows or widowers from a same-sex relationship could be paid death benefits in full. I don’t know of any restriction that it would only be accumulated benefit since the amendment date.

However, the individual fund’s trust deeds could still override this, as the amendments are not part of the operating standards, so the part in discretion of the fund is correct.
